Terms of Use

1. Who we are

These Terms of Use ("Terms") govern your download and use of the AirTouch application for macOS (the "App") and the airtouch website (the "Site"). By installing the App or using the Site, you agree to these Terms. If you do not agree, do not install or use AirTouch.

2. The beta and pricing

AirTouch is a paid app, currently offered in beta. It is available on a one-time (lifetime) or recurring (subscription) basis; current pricing is shown in the app at the time of purchase and may change. Beta software is a work in progress: features may change, break, or be removed, and gesture recognition may behave unpredictably. Do not rely on the App in situations where a misfired click, keystroke, or shortcut could cause harm or loss.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Mac computers that you own or control, for personal or internal business use. We retain all rights, title, and interest in the App, including all intellectual property rights. You may not:

4. Custom gestures and dictation

AirTouch lets you record custom gestures and bind them to actions, including shortcuts, scripts, and applications, and lets you dictate text into any field. You are responsible for what your bindings do. A gesture bound to a destructive script will run that destructive script. Review what you bind, and use the panic key (tap esc twice) if the App ever needs to let go.

5. Permissions

The App requires macOS permissions to function: Camera (to see your hand), Accessibility (to move the cursor and send input), and, if you use dictation, Microphone. You can revoke these at any time in System Settings; the App will stop the corresponding features. All processing is performed on your Mac — see our Privacy Policy.

6. Updates

We may provide updates that change or remove functionality. The App may check for updates; installing them is required to keep using the beta if a build expires or contains a critical fix.

7. Disclaimer of warranties

THE APP AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GESTURE RECOGNITION WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE APP OR THE SITE. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Termination

You may stop using the App at any time by deleting it. We may terminate or suspend the license if you breach these Terms. Sections 7, 8, and 10 survive termination.

10. Governing law

These Terms are governed by the laws of France, without regard to conflict of law principles. Any dispute will be subject to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer law provides otherwise.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the latest version. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
